| To use the Wish List, you must first create a free BuySnow.com account and are subject to the terms and conditions of the BuySnow.com website. The Wish List is for BuySnow.com customers only. The Wish List is for people to select snowboards and apparel they would like others to purchase for them. Wish Lists are set up to be shared for shopping convenience and for no other reasons. |

| If you create a wish list through our website, you must provide your name, e-mail address and a password and other personal information as well as product preferences. All information is subject to the terms of our Privacy Policy. |

| Use Of Your Friends And Family E-mail Addresses |
| If you give us the e-mail address of your family and or friends, we will use their e-mail addresses only to send them a copy of your wish list. Their e-mail addresses will not be used or shared for any other purpose. |

| By choosing to send your wish list to your friends and family, you authorize BuySnow.com to use your e-mail address to send your list to them. |

| No Spam, Damages |
| BuySnow.com will immediately terminate any account of any person that it believes, in its sole discretion, is using the Wish List in connection with any spam or other unsolicited bulk e-mail or using the Wish List to harass or to send unwanted communications. In such instance, BuySnow.com shall have the right to an injunction and to seek monetary damages. |

| You agree to indemnify BuySnow.com, its parents, subsidiaries, affiliates, officers, directors, shareholders and employees for any claim, including payment of reasonable attorney’s fees, asserted by any third party arising from any misuse of the Wish List by you. |
